Provider and scope

Screenshot Easy is provided by Xereon ICT, trading as Ice Cold Apps, Huis De Stelt 18, 6663 BA Lent, the Netherlands. Contact for support, complaints, privacy, security reports and account deletion: android@icecoldapps.com.

These terms govern new agreements for the Screenshot Easy account, cloud and associated website and app features from the stated version. Publishing a new version does not retroactively replace an earlier accepted agreement.

App-store purchases are also subject to the applicable store terms; statutory rights against the seller remain available.

Agreement and definitions

The agreement is formed when you expressly accept the offered terms during registration and your account is created. The terms and privacy notice are available beforehand and can be saved as standalone copies. The acceptance checkbox is not selected in advance.

We retain the accepted version, language, full document text and checksum, server timestamp and client-reported registration channel with your account. The privacy notice explains data processing; acknowledging it does not authorise advertising or other optional processing.

A consumer uses the service for purposes outside their trade or profession. A business customer acts in the course of a business or profession. Business-specific provisions apply only in the latter case. Separately agreed written terms take precedence over conflicting provisions here to the extent permitted by law.

Account and minimum age

New cloud accounts are available only to people aged 18 or older. Registration includes your declaration that you meet this age requirement; we do not collect a birth date or identity document for it.

This is a self-declaration, not independent age verification. App-store age ratings for local app features are separate.

Provide accurate details and act for an organisation only with authority. Verify your email before cloud synchronisation.

Protect passwords, MFA codes and devices and report misuse. If an account does not meet the age requirement, we may proportionately restrict cloud access and handle deletion while respecting statutory rights.

You are not automatically liable for every third-party action.

Service and charges

A free cloud account currently includes 2 GB across owned workspaces and a 250 MB limit per upload. Trash counts until permanently deleted.

Some app editions or external services may be paid. Price, renewal, cancellation and other purchase conditions must be presented before a purchase.

Creating an account does not authorise new charges. Statutory withdrawal, guarantee and refund rights remain available.

Consumer withdrawal rights

Where a distance agreement carries a statutory right of withdrawal, you may withdraw without giving a reason within 14 days of conclusion by contacting android@icecoldapps.com or the postal address above. For example: "I withdraw from my agreement for [service], concluded on [date], in the name of [name and account email].

Date: [...]." A paper letter can be signed; use of this example is optional. The terms checkbox alone does not waive withdrawal rights.

Where immediate performance or loss of withdrawal rights requires a separate express request, consent or acknowledgement, we obtain it for the relevant purchase. We do not charge for performance during the withdrawal period without a valid basis.

On valid withdrawal we return payments within the statutory period, normally 14 days, using the same payment method unless otherwise agreed without additional charges. An app store may handle the practical refund; statutory rights are not restricted.

Rights to your content

You retain the rights to your captures and other content. You grant us a non-exclusive permission limited to the operations needed to provide your selected service: storage, technical reproduction, synchronisation, processing and sharing. Providers engaged by us may perform those operations only for that purpose. The permission ends when the relevant content is deleted, subject to necessary winding down, the described backup expiry and mandatory legal retention.

You are responsible for having authority to record, upload and share the content, including the rights of individuals and third parties. You do not transfer ownership to us or authorise us to sell the content independently, publish it for advertising or use it for our own AI training.

Workspaces and sharing

Workspace access depends on roles. Anyone receiving a public share link may access its content, including descendants of a shared folder.

Passwords, expiry or revocation restrict future access but cannot retrieve copies already made by others. Hiding a download button cannot prevent copying visible content.

Do not share secrets or personal information without authority.

Responsible and lawful use

Use the service lawfully and respect others’ rights and safety. Unlawful content, copyright infringement, malware, harassment, fraud, unauthorised access and bypassing or disrupting security are prohibited. Do not use storage or sharing for unsolicited mass communications, harmful downloads or circumvention of account and capacity limits.

Conduct security research on our systems only within prior agreed permission. Report suspected vulnerabilities confidentially to the contact address without sending unnecessary personal information or extracted files. This provision does not exclude legally permitted activities, including applicable interoperability rights.

Software, external services and AI

App stores, operating systems, networks and AI providers you select may have their own terms, privacy policies and charges. With optional AI you choose the provider and what content to send; also check automatic-processing settings.

AI output can be wrong. Review it before relying on it, especially for decisions about people or confidential information.

Send only data you are authorised to disclose. Our own statutory responsibilities remain.

Software and brand rights remain with their owners; you receive the permission needed to use the offered features. Open-source components remain subject to their supplied licences.

Availability and backups

We maintain the service with the care reasonably expected of a provider. Maintenance, failures or necessary security measures may temporarily affect availability. A specific availability guarantee or service level applies only if separately agreed in writing.

Keep a usable independent copy of important files. The cloud is not an archive guaranteeing indefinite retention or a replacement for an independent backup plan. Do not use it as the sole provision for safety-critical processes or the only storage of irreplaceable information. This advice does not reduce our statutory duties, remediation obligations or your statutory remedies.

Events beyond reasonable control

If performance is temporarily impossible because of an event that is not attributable to us under applicable law, affected obligations may be suspended for as long as necessary. We explain the consequences and take reasonable steps to limit harm and duration.

An attack, supplier outage or lack of capacity is not automatically such an event. The cause, foreseeability and precautions reasonably expected remain relevant. Statutory termination and refund rights continue to apply to prolonged inability to perform.

Security and incidents

We apply appropriate technical and organisational measures proportionate to the risks. No internet service is entirely free of defects, attacks, loss or unauthorised access.

This does not waive our statutory security, investigation, remediation or notification duties. We handle incidents under applicable law.

Loss caused by an attack is not automatically assigned to you or categorically excluded.

Access restrictions and cancellation

We may proportionately restrict access for a concrete security threat, unlawful content, abuse, a legal obligation or a material breach. Except in urgent cases or where disclosure is legally prohibited, we explain the reason, scope and available remedies or objections.

Reports and objections receive human review. You can end the agreement and request deletion through Account deletion or the contact email.

Disconnecting or uninstalling does not delete an account. Download important content first or request export assistance.

After proportionate identity verification we remove account and cloud data no longer needed, explaining shared-workspace effects, legal exceptions and backups. Where legally required, we provide content you supplied or created free of charge within a reasonable time in a commonly used machine-readable format, subject to statutory exceptions including certain jointly used content.

Service changes and closure

We may change the service for necessary security, legal compliance, technical compatibility or feature improvements. Non-essential changes require a valid reason, do not add charges without a separate agreement and are clearly communicated.

For a change that adversely affects access or use beyond a minor degree, we notify you reasonably in advance by email of its nature, timing and your rights. Where statutory digital-service rules apply, you may terminate without charge within 30 days of that notice or the change, whichever is later, unless you can retain the unchanged, conforming service without extra cost.

Other materially adverse changes to the terms require consent where applicable. Planned complete closure normally includes at least 30 days to retrieve content; urgent legal or security reasons may require a shorter period.

Statutory remedies, applicable refunds and necessary security updates remain available. Earlier versions and acceptance evidence are not rewritten.

Liability

For consumers, statutory liability rules apply; these terms impose no general exclusion or fixed monetary cap on them. Only for business customers, and to the extent permitted by law, liability for attributable direct loss per contract year is capped at the higher of EUR 1,000 or the fees that customer paid us for the affected service in the twelve months before the incident.

Related events count as one incident. For business customers, indirect loss such as lost profits, lost savings and business interruption is excluded where permitted.

The exceptions in the following section always prevail. Reasonable costs to establish or mitigate foreseeable direct loss and restore lost data are not excluded from direct loss merely by their description.

An incident does not automatically entitle a user to a fixed payment.

Statutory rights and exceptions

Nothing excludes or limits liability for intent, recklessness or gross negligence, death or personal injury for which we are responsible, or liability that cannot lawfully be limited. Mandatory consumer rights, obligations concerning digital content and services, and GDPR rights including any right to compensation remain unaffected.

Ambiguities must be interpreted consistently with those rights.

Business third-party claims

A business customer indemnifies us only against third-party claims arising directly from an infringement attributable to that customer through supplied content or unlawful instructions. This indemnity does not cover harm caused by our own breach or circumstances attributable to us.

We notify the customer promptly, reasonably mitigate harm and allow the defence to be conducted in consultation. We do not admit liability or agree a settlement payable by the customer without its prior written consent. Only reasonable, necessary costs and amounts legally established or approved in writing are covered. This provision does not apply to consumers or restrict individuals’ independent statutory rights or regulators’ powers.

Reports of unlawful content

Report unlawful content or infringement to android@icecoldapps.com. Include the exact share link or other location, a specific explanation, available supporting information and a contact address.

Do not send additional copies of sensitive or unlawful material. We acknowledge and assess sufficiently specific reports carefully and impartially, take proportionate action where needed and inform affected people of the outcome and the option to object through the same address, unless prohibited by law.

Urgent measures are assessed separately.

Complaints and applicable law

Dutch law applies. Consumers retain mandatory protections of their country of habitual residence and access to courts having statutory jurisdiction.

There is no compulsory arbitration or exclusive Dutch court clause for consumers. Send a short complaint and the requested remedy to android@icecoldapps.com; we aim to respond substantively within 14 days and explain if more time is needed.

You may always contact the competent regulator or court. An invalid term does not invalidate other valid terms and is not automatically replaced with a less favourable consumer term.

Business processing: roles

When a business customer has personal data processed in the cloud for its own purposes, that customer is controller and we act as processor for that content. The following processing terms form part of the agreement in that case; a customer acting as processor must be authorised to appoint a subprocessor.

We are a separate controller for our own account administration and security purposes. The customer ensures a lawful basis, notices to individuals and authorised users.

Do not send special-category or criminal-offence data without first arranging specific appropriate terms and safeguards.

Business processing: instructions

The subject and duration are the selected cloud functions during the agreement and necessary winding down. Operations include receiving, storing, organising, searching, synchronising, sharing on instruction, restoring and deleting captures and metadata.

Data may include names, contact details, images, voice, screen content and usage metadata concerning users, employees, customers and others recorded by the customer. We process only on documented instructions, including settings and authorised requests, except for binding legal duties disclosed in advance unless prohibited.

We flag instructions we consider unlawful and suspend the affected operation where necessary. Content is not used for our own advertising or training our own AI models.

Business processing: security and assistance

We restrict access to authorised people bound to confidentiality, use encrypted connections, password hashing, access roles, security records and restricted backup access, and assess and maintain appropriate security. MFA is available; cloud files are not end-to-end encrypted.

Taking the processing and available information into account, we assist the customer with rights requests, security, impact assessments and consultation with regulators. We notify the customer of a personal-data breach without undue delay, provide available information about its nature, consequences, contact and measures, and supply missing details subsequently.

The customer decides on its own notification duties. We provide information needed to demonstrate compliance and cooperate with reasonable audits by the customer or its independent auditor; scheduling and confidentiality must not obstruct statutory scrutiny.

Business processing: suppliers and termination

The customer authorises Hetzner for the current infrastructure in Germany. We impose equivalent data-protection duties on subprocessors and remain responsible for their performance.

We announce new or replacement subprocessors by email at least 30 days in advance, allowing data-protection objections; if no suitable solution is possible, the affected service can be ended without charge before the change. Transfers outside the EEA on our instructions require a valid mechanism under GDPR Chapter V and information on safeguards.

At the end of processing we return or delete personal data at the customer’s choice and delete copies, subject to mandatory legal retention and the explained, restricted backup expiry. Deletions are reapplied after restoration.

These processing terms prevail over conflicting general provisions concerning personal data and do not limit individuals’ rights.
